1. ACCEPTANCE OF TERMS

Welcome to the official website of LaunchProject LLC (“LaunchProject,” “we,” “our,” or “us”). These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User,” “you,” or “your”) and LaunchProject LLC regarding your access to and use of all services, content, features, tools, and functionalities offered through the LaunchProject website, located at https://launchproject.dev (“Site”).

By using, accessing, browsing, or interacting with our Site, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to all the provisions of these Terms, please refrain from accessing or using the Site and its associated services. Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes.

These Terms apply to all visitors, users, and others who access or use the Site. This includes all of our officers, directors, employees, contractors, agents, licensors, subsidiaries, affiliates, and service providers who contribute to the operation and management of the Site.

  • “User,” “you,” or “your”: These terms identify any person or entity accessing or interacting with the Site, whether as a client, potential client, partner, consumer, collaborator, or casual visitor. Users accessing on behalf of another entity shall be deemed to have authority to act on that entity’s behalf.

  • “Site”: This term refers to the official website of LaunchProject, including all features, functionalities, tools, content, media, and digital infrastructure hosted at https://www.launchproject.com or any related subdomain or application associated with LaunchProject.

  • “Content”: Any and all visual, textual, audio, digital, software, or multimedia material found on the Site, including but not limited to documents, graphics, articles, logos, source code, trademarks, blog posts, marketing materials, and video or audio recordings.

LEGAL REPRESENTATION OF ELIGIBILITY AND CONSENT TO TERMS

You acknowledge and consent to the incorporation of these Terms by reference into all other contracts you may enter into with LaunchProject. Should a conflict arise between these Terms and any individual agreement, the terms of the latter will prevail only if expressly stated.

All persons accessing or using the Site on behalf of another individual or entity represent that they have obtained all necessary consents and authorizations. Failure to secure consent does not absolve you from personal liability under these Terms.

By accessing and using the Site, you are granted a limited, non-exclusive, non-transferable, revocable license solely to view and use the Content for your personal, non-commercial purposes in accordance with these Terms. If the Site permits user-generated content, comments, reviews, or other submissions, LaunchProject does not pre-screen, endorse, or guarantee the accuracy or appropriateness of such submissions. We reserve the right, but are not obligated, to monitor, edit, or remove user-generated Content that we deem unlawful, harmful, offensive, or in violation of these Terms.

You are solely responsible for any Content you submit or post on the Site. By submitting Content, you grant LaunchProject a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, translate, distribute, and display such Content in any media or format.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, LaunchProject, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, goodwill, data, or other intangible losses resulting from:

  • Your access to, use of, or inability to use the Site or its Content.

  • Errors, omissions, or inaccuracies in the Site’s Content.

  • Reliance on any information obtained from the Site.

  • Third-party Content or links accessed through the Site.

  • Unauthorized access to or alteration of your transmissions or data.

This limitation of liability applies regardless of whether such damages arise under contract, tort, negligence, strict liability, or other legal theories.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LaunchProject and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney’s fees) arising from:

  • Your violation of these Terms or applicable laws.

  • Your misuse of the Site or its Content.

  • Your infringement of any third party’s rights, including intellectual property rights.

  • Any claim resulting from your Content or interactions on the Site.

NO LIABILITY FOR INTERRUPTIONS OR ERRORS

LaunchProject does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any technical malfunctions, failures, delays, or inaccuracies caused by external factors or beyond our reasonable control.

RESERVATION OF RIGHTS AND MODIFICATION OF TERMS

LaunchProject expressly reserves all rights not expressly granted to you under these Terms. The rights granted herein are limited to those necessary for you to access and use the Site as permitted. Any rights not expressly granted are reserved by LaunchProject and its licensors.

Right to Modify Terms and Conditions

LaunchProject reserves the unilateral right, at its sole discretion, to amend, modify, update, or replace any part of these Terms of Service at any time. Such modifications may be necessary to reflect changes in legal requirements, business practices, technological advancements, or to improve the Site’s functionality and user experience.

When changes are made, LaunchProject will update the “Effective Date” at the top of these Terms and post the revised Terms on the Site. It is your responsibility to regularly review these Terms to stay informed of any modifications. Continued use of the Site after any updates or changes constitutes your acceptance of the revised Terms.

Suspension or Termination of Access

LaunchProject may, without prior notice and at its sole discretion, suspend, restrict, or terminate your access to the Site or any portion thereof if we determine that you have violated these Terms, engaged in fraudulent, abusive, or unlawful conduct, or in any way harmed or threatened the security, integrity, or reputation of the Site.

Termination or suspension of your access shall not limit LaunchProject’s right to pursue any other remedies available under law or equity. You agree that LaunchProject shall not be liable to you or any third party for any termination or suspension of access.

THIRD-PARTY RIGHTS

Certain features or Content on the Site may be subject to licenses or agreements with third-party providers or licensors. LaunchProject may grant rights or permissions to third parties to access or use specific portions of the Site in accordance with those agreements.

Such third-party users must comply with all applicable terms and conditions specified by LaunchProject or the third-party provider. LaunchProject reserves the right to revoke or modify any such third-party access or permissions at any time without prior notice.

RIGHT TO MODIFY SITE CONTENT AND SERVICES

LaunchProject reserves the right to add, modify, suspend, discontinue, or remove any features, services, Content, or functionalities available on the Site, either temporarily or permanently, without notice and without liability.

We do not guarantee continuous availability of any part of the Site and expressly disclaim any responsibility for any loss or damage resulting from such modifications or discontinuations.

REFUND POLICY

At LaunchProject, we strive to provide the highest quality products and services to meet our customers’ expectations. We understand that circumstances may arise where a refund request is necessary. This Refund Policy outlines the conditions under which refunds may be granted and the process for requesting one.

Eligibility for Refunds

Refunds are not automatically granted and will only be issued upon the express approval of LaunchProject’s management team. All refund requests are subject to a thorough review and evaluation to ensure compliance with our policies and applicable laws.

Refunds may be considered under limited circumstances, including but not limited to:

  • Failure to deliver the purchased product or service within the agreed timeframe.

  • Significant defects or errors in the product or service that cannot be reasonably remedied.

  • Other exceptional circumstances as determined at the sole discretion of LaunchProject management.

Refunds will not be issued for:

  • Change of mind or buyer’s remorse.

  • Misuse, unauthorized modification, or damage caused by the user.

  • Services or products that have been fully delivered and accepted without prior dispute.

  • Any circumstances not explicitly approved by management.

Refund Request Process

To request a refund, you must contact our customer support team promptly at business@launchproject.dev, providing the following information:

  • Your full name and contact details.

  • Order or transaction number.

  • Detailed explanation of the reason for the refund request.

  • Any supporting evidence, such as screenshots, correspondence, or other relevant documentation.

Upon receipt of your request, LaunchProject will acknowledge it within a reasonable timeframe and initiate a review. Management will assess the validity of the claim, taking into consideration the nature of the product or service, the timeline, and any mitigating factors.

Management Review and Decision

The management team holds sole discretion to approve or deny refund requests. The decision will be communicated to you in writing, typically within 14 business days of receiving your complete refund request.

If approved, the refund will be processed through the original payment method used for the purchase unless otherwise agreed. The timing of the refund processing depends on the policies of the payment provider and financial institutions involved and may take several business days.

If your refund request is denied, you will be provided with an explanation. Management’s decision is final and binding.

SCAM REPORT AND NON-PAYMENT POLICY

At LaunchProject, we uphold the highest standards of professionalism and integrity in all our business dealings. We expect our clients and partners to honor their contractual obligations, including timely payment for products and services rendered. This Scam Report and Non-Payment Policy outlines the procedures and actions that will be taken if a client fails to fulfill their payment obligations or engages in fraudulent behavior.

Payment Obligations

All payments for services or products provided by LaunchProject must be made according to the terms specified in the relevant agreements, invoices, or purchase orders. Failure to remit payment by the agreed-upon deadlines constitutes a breach of contract.

Consequences of Non-Payment

If a client fails to pay for services or products within the stipulated timeframe, LaunchProject reserves the right to:

  • Suspend or terminate any ongoing services or access to products until payment is received in full.

  • Withhold delivery of any pending products or services.

  • Pursue all available legal remedies to recover outstanding amounts, including but not limited to initiating collection procedures or legal action.

Reporting of Fraudulent Activity

If LaunchProject reasonably suspects that a client has engaged in fraudulent activities, such as intentionally avoiding payment, providing false information, or misrepresenting themselves, we reserve the right to report such activities to appropriate authorities or regulatory bodies.

This may include:

  • Reporting to credit bureaus or financial institutions.

  • Filing complaints with consumer protection agencies or law enforcement.

  • Sharing information with industry watchdogs or fraud prevention organizations.

Cooperation with Investigations

Clients and users agree to cooperate fully with any investigation initiated by LaunchProject regarding suspected non-payment or fraud. Failure to cooperate may result in immediate suspension of services and further legal action.

Notification and Resolution Attempts

Prior to taking any formal action, LaunchProject will attempt to contact the client through the provided communication channels to resolve payment issues amicably. Clients are encouraged to communicate proactively if experiencing difficulties with payment arrangements.

Indemnification

Clients agree to indemnify, defend, and hold harmless LaunchProject and its affiliates from any claims, damages, losses, liabilities, or expenses arising from their failure to pay or any fraudulent conduct.

Limitations

This policy does not limit LaunchProject’s right to pursue any other remedies available under law or contract to enforce payment or protect its interests.
